Terms of service

Last updated: 30 September 2026

These Terms of Service govern your access to and use of the MALEIA website and your purchase of products and services from MALEIA. Please read them carefully before using our website or placing an order.

MALEIA is operated by Ajaz Holdings Pty Ltd (referred to in these Terms as “MALEIA”, “we”, “us” or “our”). By accessing our website, using our services or placing an order with us, you agree to these Terms of Service together with the policies referred to in them, including our Shipping & Delivery Policy, Returns, Cancellations & Warranty Policy and Privacy Policy.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law (ACL).

1. Eligibility & Online Store Use

By using our website or placing an order, you represent that you have legal capacity to enter into a binding agreement. If you permit a minor to use the website under your supervision, you are responsible for that use to the extent permitted by law.

You must not use our website, products or services for any unlawful or unauthorised purpose, infringe the rights of another person, transmit malicious code, attempt to compromise the security or operation of the website, or otherwise use the website in a manner that could damage MALEIA or another person.

We may suspend or restrict access to the website where reasonably necessary to protect the website, our customers, our systems or our legal rights.

2. Products, Materials & Product Information

MALEIA offers furniture, lighting, decorative objects and related products. Some products may be in stock, while others may be made to order, pre-order, customised or specially procured.

We make reasonable efforts to ensure product descriptions, specifications, dimensions, images, materials, finishes and pricing are accurate. However, minor variations may occur due to manufacturing processes, photography, lighting, display settings and the characteristics of natural materials.

Products incorporating natural materials such as marble, travertine, stone and timber may vary in colour, grain, veining, texture, pores, pattern and surface character. These inherent variations are addressed further in our Returns, Cancellations & Warranty Policy.

We may update product descriptions, specifications or availability from time to time. Any material change affecting an accepted order will be handled in accordance with applicable law and the terms applying to that order.

3. Pricing, GST & Payment

Unless otherwise stated, prices displayed on our Australian website are in Australian dollars (AUD) and include GST where GST is applicable.

Delivery, installation, specialist handling, storage or other additional services are not included in the product price unless expressly stated. Applicable delivery or additional charges will be displayed at checkout, quoted separately or otherwise agreed before the relevant service is provided.

Prices may change at any time before an order is accepted. A later price change does not alter the agreed price of an order already accepted by MALEIA, except where required or permitted by law or where the customer agrees to a change.

Payment must be made using a payment method made available by MALEIA. You are responsible for providing accurate billing and payment information and for being authorised to use the selected payment method.

4. Orders & Order Acceptance

Submitting an order does not necessarily mean that MALEIA has accepted it. After you place an order, we may send an acknowledgement confirming that we have received your order. An order is accepted when MALEIA confirms acceptance or otherwise begins fulfilling the order, subject to applicable law.

We may decline or cancel an order where reasonably necessary, including where:

·        A product is unavailable or discontinued

·        There is an obvious pricing, description or technical error

·        Payment is not authorised or cannot be verified

·        We reasonably suspect fraud, misuse or an unauthorised transaction

·        We cannot reasonably deliver the product to the nominated address

·        An order exceeds reasonable purchase quantities or appears to be placed for unauthorised resale

If we cancel an accepted order because we cannot supply it, we will refund amounts paid for the affected product and any applicable undelivered service.

5. Cancellations, Returns & Warranties

MALEIA does not offer cancellations, refunds, exchanges or returns for change of mind once an order has been accepted, including where an accepted order has not yet been dispatched. This does not affect rights available under the Australian Consumer Law.

Made-to-order, customised, bespoke, specially procured, clearance, ex-display and floor-model products are also subject to our Returns, Cancellations & Warranty Policy.

MALEIA currently provides a 5-year structural voluntary warranty for furniture and a 2-year voluntary warranty for lighting, subject to the terms and exclusions set out in our Returns, Cancellations & Warranty Policy. These voluntary warranties are additional to rights under the Australian Consumer Law.

6. Delivery, Access & Collection

Delivery is governed by our Shipping & Delivery Policy. Delivery availability, charges and timeframes depend on the product, destination, carrier availability, handling requirements and property access.

You are responsible for providing accurate delivery information and for checking that products can safely pass through entrances, doorways, hallways, stairs, lifts and other access points. Additional charges may apply where a delivery cannot be completed because of customer-caused access issues or undisclosed delivery conditions, as described in our Shipping & Delivery Policy.

Delivery timeframes are estimates unless expressly stated otherwise. Where a material delay occurs, we will deal with the delay in accordance with applicable law and our Shipping & Delivery Policy.

7. Lighting & Installation

Unless expressly stated otherwise, MALEIA lighting is supplied on a delivery-only basis and electrical installation is not included.

Hardwired lighting, including wall sconces, pendants, chandeliers and ceiling lights, should be installed by an appropriately licensed electrician in accordance with applicable Australian requirements.

MALEIA is not responsible under its voluntary warranty for damage caused by incorrect installation, unauthorised modification, incorrect electrical supply or misuse. This does not limit any rights under the Australian Consumer Law relating to a defect or failure attributable to the product itself.

8. Accuracy of Account, Billing & Delivery Information

You agree to provide current, complete and accurate information when placing an order, including your name, contact information, billing details and delivery address.

You should promptly notify MALEIA of any change to your contact or delivery details. Once an order has been dispatched, changes may not be possible and additional carrier charges may apply.

9. Website Availability & Errors

We aim to keep the website accurate and available, but we do not guarantee that access will always be uninterrupted, secure or error-free.

The website may occasionally contain typographical errors, technical errors, inaccurate stock information or omissions relating to product descriptions, pricing, promotions, delivery charges, transit times or availability. We may correct these errors when identified.

If an error materially affects an order you have placed, we will contact you and deal with the order in accordance with applicable law. We will not use this clause to remove rights that cannot lawfully be excluded.

10. Intellectual Property

Unless otherwise stated, the content of the MALEIA website, including branding, logos, product names, photographs, graphics, text, design elements and website content, is owned by or licensed to MALEIA and is protected by applicable intellectual property laws.

You may access and use the website for personal, non-commercial purposes. You must not reproduce, republish, distribute, modify, commercially exploit or use our content to create derivative commercial materials without our prior written permission, except where permitted by law.

11. Reviews, Feedback & User Submissions

If you submit a review, photograph, comment, suggestion or other content to MALEIA, you confirm that you have the right to provide that content and that it does not infringe another person’s intellectual property, privacy or other legal rights.

Where you submit content for publication or promotional use, you grant MALEIA a non-exclusive, worldwide, royalty-free licence to reproduce, display and use that content for operating, marketing and promoting MALEIA, unless otherwise agreed in writing. You retain ownership of your content.

We may moderate or remove user-submitted content where reasonably necessary, including content that is unlawful, misleading, abusive, infringing, malicious or unrelated to the relevant product or service.

12. Third-Party Services & Links

Our website may contain links to or integrations with third-party websites, payment providers, delivery providers or other services. Those third parties may have their own terms and privacy practices.

MALEIA is not responsible for the content or operation of an independent third-party website merely because we provide a link to it. Nothing in this clause excludes responsibility that MALEIA has under applicable law for services supplied by or on behalf of MALEIA.

13. Privacy

Personal information provided to MALEIA is handled in accordance with our Privacy Policy and applicable privacy laws. Please review our Privacy Policy for information about how we collect, use, disclose and protect personal information.

14. Prohibited Uses

You must not use the website or its content to:

·        Engage in unlawful, fraudulent or misleading conduct

·        Infringe MALEIA’s or another person’s intellectual property rights

·        Upload or transmit malicious code

·        Attempt to gain unauthorised access to accounts, systems or data

·        Scrape, harvest or collect personal information in breach of law

·        Interfere with the security, performance or operation of the website

·        Impersonate another person or provide materially false information

·        Harass, threaten, defame or unlawfully discriminate against another person

We may restrict access where we reasonably believe these conditions have been breached.

15. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms, our Returns, Cancellations & Warranty Policy, our Shipping & Delivery Policy or any other MALEIA policy is intended to exclude, restrict or modify these rights where it would be unlawful to do so.

16. Liability

To the maximum extent permitted by law, MALEIA is not liable for loss or damage caused by your misuse of a product, failure to follow care or installation instructions, unauthorised modification, or use of a product for a purpose for which it was not designed.

To the extent permitted by law, MALEIA is not responsible for losses that are not reasonably foreseeable as a result of a breach by MALEIA. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising under applicable consumer guarantees.

17. Indemnity for Misuse of the Website

To the extent permitted by law, you are responsible for loss suffered by MALEIA arising directly from your unlawful use of the website, your infringement of another person’s rights, or your material breach of these Terms, to the extent that the loss was caused by your conduct. This clause does not require you to indemnify MALEIA for loss caused by MALEIA’s own negligence, breach or unlawful conduct.

18. Suspension & Termination of Website Access

You may stop using the website at any time.

MALEIA may suspend or terminate your access to the website where reasonably necessary because of unlawful activity, fraud, security concerns, material breach of these Terms or conduct that threatens the operation of the website or the rights of others.

Termination of website access does not affect rights or obligations that accrued before termination, including obligations relating to an accepted order.

19. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be read down or severed to the extent necessary, and the remaining provisions will continue to operate to the extent permitted by law.

20. No Waiver

If MALEIA does not immediately enforce a right under these Terms, that does not mean MALEIA has waived that right. A waiver is effective only to the extent expressly given.

21. Entire Agreement & Related Policies

These Terms, together with any order confirmation and the policies expressly incorporated into them, form the agreement governing your use of the website and purchases from MALEIA, subject to any rights that cannot lawfully be excluded.

If there is an inconsistency between these Terms and a specific written term agreed by MALEIA for an individual order, the specific written term will apply to that order to the extent of the inconsistency, subject to applicable law.

22. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws of Australia. Subject to any rights you may have to bring proceedings elsewhere, the courts and tribunals of New South Wales may hear disputes arising in connection with these Terms.

23. Changes to These Terms

We may update these Terms from time to time by publishing a revised version on our website. The updated Terms will apply to use of the website after they take effect.

Changes will not retrospectively alter the agreed terms of an order already accepted by MALEIA unless the change is required by law or agreed with you.
